Real Estate
For most people, buying or selling a home is one of the largest transactions they will enter during the course of their liftetime. This is especially true in the Commonwealth of Massachusetts which has some of the highest real estate prices in the country. An attorney functions to protect a client's interest and to ensure that the other party to a transaction performs pursuant to the terms of a written and duly executed purchase and sale agreement. A purchase and sale agreement should contain certain well drafted clauses including contingencies specific to the buyer or seller. A deed should also be carefully reviewed and/or drafted as it is typically the legal document that "survives the closing" or defines the terms of the transaction. Closing documents should be carefully reviewed so that the client fully understands the terms of a loan product such as the interest rate, closing cost, and whether the loan contains a prepayment clause or variable rate feature. An attorney also serves to protect the buyer's interest after the formal closing by drafting and recording a Declaration of Homestead. This legal document protects a person's primary residence against creditors under some circumstances. Hiring an attorney when buying or selling a home is a wise investment.
