Landlord Tenant Law

Landlord Tenant Law

Attorney Ciulla represents both landlords and tenants in housing related matters.  He has handled cases involving the following areas:

  • Eviction or summary process
  • Breach of the State Sanitary Code and the Implied Warranty of Habitability
  • Breach of the Implied Covenant of Quiet Enjoyment
  • M.G.L. Chapter 93A or the Consumer Protection Statute
  • Breach of Contract
  • Retaliatory Eviction
  • Security deposit and last month's rent violations

The Law in the Commonwealth of Massachusetts imposes certain rights and obligations on both landlords and tenants.  If either party violates these obligations, liability can be imposed in the form of monetary damages and/or possession of the premises.  Tenants may be entitled to attorney's fees under certain circumstances.

Eviction proceedings are quite different than civil litigation in general as the former type of cases move rapidly from the initial notice to quit to actual trial and judgment, hence the term "summary."  There are also technical procedural requirements in terms of filing and answering a complaint and in conducting discovery.  These requirements are extremely time sensitive.
